It is no secret that Texas land sales and housing starts have been booming for many years. Many of these properties exchange hands without a proper individual survey. In rural areas, years sometime pass after a landowner inherits or purchases a piece of property only to find that where the property lines were historically thought to be come into dispute when a neighbor erects a new fence or house. Further, with drone ownership, property rights and boundary disputes are becoming more prevalent. It may be as simple as a fence veering over the property line or a serious as a building which has been built on the property line. Title insurance may be a partial solution depending on the circumstances, but this is by no means a sure bet.

Time is of the essence

Land problems and disputes should be addressed immediately. These disputes do not get better with time and may even become worse, including the inability to sell your property due to the cloud on the title or in extreme cases, some of your land could be taken by adverse possession.   • The first step in resolving a land problem is to understand exactly what is being complained about by your neighbor, HOA or governmental entity.
  • The next step is to collect your documents such as the deed, and copies of easements, copies of executed side agreements, if any and certainly a copy of your survey and title insurance, if any.
  • Once these are reviewed it may be more cost efficient to attempt to settle the dispute with a Boundary Line Agreement, an Easement Agreement or a Quit Claim Deed.
